Cabinet Talks Collapse
Well, I guess there’s no surprise here that the talks have collapsed. Like I said in a previous piece, Mutula Kilonzo and Martha Karua are very smart lawyers. They simply outwitted James Orengo when it came to drafting that agreement.
Isn’t that the first thing they teach you in a contracts class? never, ever, write generalized contracts and make sure everything in there (from the full stops to the comma’s) are exactly where you want them to be; leave nothing to interpretation. I knew they were going to start arguing over it’s interpretation and anyone who read that agreement would have seen this coming.
You know what? I don’t even know how you can feel bad for ODM. Why didn’t they hire a law firm to help them? instead of spending money on those buffets at the Serena hotel (are you listening Mudavadi? ease up on those skirt steaks); They should have spent a little money on outside legal advisers.
As the great orator himself George Bush says: “There’s an old saying in Tennessee — I know it’s in Texas, probably in Tennessee — that says, fool me once, shame on — shame on you. Fool me — you can’t get fooled again.” :roll:
I’m going to come up with my own version of this saying, just like George Bush, but apply it in the context of Raila Odinga’s political career. Let’s see:
“Fool me once. Fool me twice. Fool me thrice.
Fool me!
You Foolish!
shame on you. Nay. Shame on me.

Why is this baby crying? what? you don’t what to be the next minister of national harmony and rice enterprises?

KE; As you ignorantly celebrate the brain power of Karua and Kilonzo, ponder this; Will the hundreds of thousands of Kikuyus living in camps be resettled in RV without the blessing of the locals? Even in your imagination, I’m sure you do not foresee sustainable forced resettlements, do you? No matter how many Mungiki join us in the RV, we shall still be chased and killed again and again. Why don’t we establish a fair coalition so that we can move to other items such as land reform that will settle this land clashes issue once and for all. Please be bright. The war is over. Let us embrace others as we expect to be embraced.
Does a 50/50 power sharing govt. need any legal description? Mbona tunacheza karata na maisha yetu? Kibaki and Karua are simply inflating the hate of Kikuyus through their deceit, untrustworthiness and greedy ways. Those are the added attributes of us Kikuyus going forward. If our leader is as cunning as a fox, why would anybody ever trust a Kikuyu. That’s the truth. Kibaki is only our president. He cannot visit anywhere else.
Here you are praising someone for intentionally drafting an unworkable law. Is that not foolish of you? Don’t you realize this involves the very lives of your kinsmen? Believe me man, we Kikuyus will continue to live in denial thinking that we will rule forever or forever influence power. The reality is that our man stole this thing outright and we continue to support him, so by extension we are also thieves. Now that he’s been caught and forced to share the loot for the sake of peace, we still support his hesitations. KIBAKI IS NOT DOING US A FAVOR!!!
For this country to heal, there needs to be honest dialogue. Tuwache hii mambo ya ukora.
Now that we’re back to violence … where do all those tyres come from?
raila amechezwa…
KE is right… She lives in the USA where contracts & agreements are super-detailed YET there is tons of litigation… Now these guys – ODM – should have done the same!
I knew there was something brewing when muthuara tested the waters by saying the Civil Service was off bounds to ODM. Remember the PS are part of the Civil Service!
mwas:
This is not about Kikuyu’s thinking that they can rule forever (what Kikuyu thinks that or even expects that?)
It is about the PRE-PLANNED violence that the Kalenjins engaged in (with complicity from Raila Odinga). I don’t understand why people keep missing this point??
Many Kikuyu’s now believe that the kalenjins (and ODM by extension) had a grand plan to just kill them off. So, if you back people into a corner like that and show them that you are serious about killing (by actually going out and killing them, they are not going to negotiate with you.
And I’m frankly getting sick of bloggers who keep writing pieces about Raila Odinga and ODM as if they are innocent angels. Raila knew what Ruto and those kalenjins were upto and now I’m beginning to believe that Raila might just be crazy (I’d heard rumours before about his mental instability especially after he got out of prison and I never believed them) but now I do.
People,
Lets see what kaleos will do, since the whole of RV is covered by security since the last violence. They need to prove themselves now.
Jaluos have uprooted the railway line again in Kibera, but have not yet burned houses.
You cannot now say that you were caught off guard, the response to any violence should be swift and stern. That’s the only way to put to an end to this nonsense.
Don’t start another discourse until justice is served and people who cause should first learn that they don’t have monopoly to violence.
Get yourselves ready for the mother of all battles.
KE are you really of a sane mind. Weren’t you the one who a few months back cried for Kenya like you cared, didn’t you say for the sake of peace that both parties should compromise.
Now your hypocrisy is being put forth for all to see. Do you guys really care about Kenya. All this childish games PNU is playing when we seek a national accord, reconcialiation etc.. Why are PNU adamant on testing the very shaky waters we are navigating at this moment.
Mark my words, Karua, Kibaki, Muthaura can play games all day if they like, but we shall see how force treats them. The only language left now is hardball.
Kenya is bigger than them and watch them get swallowed. My patience is wearing thin. First the time wasting with Annan, now this foolishness with the second phase. Good thing Kibaki can’t stand if elections were rerun. But he better get ready to run to Zimbabwe.
I love this conversation. i want as to go back to the ballot. am sick and tired of this odmers who think they can hold us hostage. never they dont have money and they know if we run this time most of them will not have a chance. i know it. you watch them they will chicken out. no propaganda since safaricomand celtel has cancelled smsing so let see we are ready. the army is in mt elgon not far from riftvalley. we just needed time and we are ready. we have money more than 10 billion for election and what does odm have ????? nothing . kalonzo is on our side and we still have some luyhas and a few kales so am ready we are ready let get this thing going. dissolve parliament. we have mungiki ready too. they did not finish what they started they raised 2 billion last year so they have alot of money and their network is big. you saw what they did the last time they turned up in town. i want new election plse we need to take care of this bastards once and for all.
i love it
@ arap sei,
Wonder if those MPs enjoying large salaries and planning for what position they should be given will agree to go back to the polls.
Also, please stop that propaganda about SMS services being cancelled. No such thing has happened (yet?).
War is a fools game. Those who want it should be prepared for the tears. Some ODM MPS might not be willing to stand in ODM again. They have been held captive by Raila Tuto Balala and Co and they may want to be more independent this tiem. The risks are too high for some ODM MPs like margaret Wanjiru who im almost sure will not see the light of parliament. Raila , Ngilu, Kibaki , Mudavadi will all recapture their seats. But expect changes, and big changes in the MPs wo won marginally, and the strategy ODM used to telll MPs to wait and let their opponents stand they will be rewarded later wont work. Theyve already seen there might be nothing to share after all. The Kikuyu 4M votes and the Eastern 600k votes is something worth thinking about. Kisiis might change their minds too. Their property was burnt and sent off Kisumu. Raila had to intervene.Winning might not be easy for either side. Safaricom will have been sold to kenyans, so cant be used to woo for funds from investors for return of their shares. The sponsors of ODM have not yet recouped their funds yet. And here comes another election. The coast businessmen might not support balala as theyve done. Theyve lost heavily on the ODM violence. TYheir transport businesses to Rwanda, Uganda, etc have all been halted and tourism come to near halt. They had to stop the madness before it spread too much in the coast and are not willing to repeat the same. They learnt good from pevious clashes .The Kalle fighting the Kisii and the Maasai at the borders might have changed poples minds politically. Majimbo is understood differently, and campaigning against other tribes is already a crime under the present ammandment act. So if you try you go to jail immediately. I underatsnd law a bit. The ammendment is already law, so we cant speak of madoadoa again. We go to jail. Elections are what MPs hate most. And if Kibaki can ask for the worst, there are 2 options. Either ODM comes down on their demands, or another Election, and Kibaki is still president. This time Kenyans can be allowed to vote from anywhere including the displaced with an E-Voting system. Truly speaking, whoever wins, violence needs time to be dealt with. Its not about Kibaki or Raila. Its about brainwashed youths, who are jobless and have lost vision in their life. Anybody can use them. I cant stand an ambassador who is ODM or PNU. Truly speaking, they should be neutral in stand. On thatMuthaura is correct. Same for permanent secretaries. These guys are proffesionals and should be hired on merit. Not on a loyalty thanking spree. I want them hired in the future by recruitment agencies as PWC. An example is how chancellors of universities are recruited these days. Bring your CV if you want the job! Thanks to PS’s, ministries are still running as our MPs are busy dividing the wealth the PS’s are makng for our country.
Odm cannot ask for a ministry of cabinet. Thats taking power from the back door. Raila supervises cabinet and reports to parliament once a week. then what will be the work of ministry of cabinet? Thats taking power through the back door. They have lost fopcus in the negotiations and its become a game of cards at the taxpayers expense. If Kibaki doesnt act tough these goons wont stop. They need to see his hard part before they know when theyve gone too far.
KE;
rumours of mental instability? how low will your blows get?
KE,ALL
coldtusker
Kalonzo ,Karua are not bright lawyers..They screwed themselves
Right now Kibaki CANNOT name a cabinet beacuse the constitution says
…..the cabinet/gov shall consist ofa Press, PM and 2 Deputies and the PM must come from the largest party…….
KIBAKI YESTERDY wanted to name his side of cabinet but Amos Wako told him it was ILLEGAL. ‘your bright lwyers again’
Leodd
Kibaki if disolves paliament wont be able to run
‘third term rule’
Leodd
Even if Kibaki was able to run……your analysis will not hold beacuse by breaking up this parliament his goose will be cooked….
It will be hard to sell him around given his failure to protect people from insecurity. International pariahood …an independent ECK which surely must be constituted before any elections..His constant Indecision all will bring down ….general malaise that has hit the country..
Do not relly on people like Kalonzo …remember he was in ODM untill the last minute
As for E~Voting …you are really not in Kenya…in any case (ECK rules will have to be changed~Raila controls parliament~remember the speaker
Kibaki is therefore stuck
He cannot dissolve (for fear of a RE RUN) or name a cabinet (because he cant’ without Raila)
Likely Option
1) accept Railas ministries and hobble along
@Pysd off
As for violence we are fortunate it will NOT crop up (why)
1) Raila wont like it because he has international goodwill (though he will call for low key strikes ..to keep the pressure)
2) Kibaki Does not like it Either because he needs to secure the country
(his work )
DO NOT FORGET THE BUDGET is there in two months~ the country is paralysed there is no money…..(thanks for SAFICM IPO) thats what we are relying upon now
Lord:
Are you sure these cabinet changes have been entrenched in the constitution? I thought they were still arguing about that. Somebody needs to clarify this point because I haven’t seen any constitutional amendments that have passed through parliament yet.
Just what:
You think that was low? 9 years in and out of kenyan prisons would make anyone crazy.
I didnt say either would have a good time on dissolution. The issue is that on disolution other parties emerge. Not everybody in ODM is happy, and at the same time voters are not for paties. The party mentality is dying slowly but surely in kenya. So ODM PNU and many other parties might take the opportunity to harvest from the windfall. Kalembe Ndile is also on the waiting list. Dont think being paid 800k a month will not attract any compe. And the game is not ovet till yopure sure you find yourself in parliament. If many people stand as presidential candidates, then depending on where they come from its going to change the totals and complicate the puzzle more. I dont support either but remember that ODm never guessed PNU’s Kibaki could get such massive votes. Elections are not fun. Hii sio time ya moi. Elections make you scratch your head till nywele zinatoka!
@KE
Bloated govt. aside,we desperately need a MINISTRY OF CIVIC EDUCATION. After watching those Kibera and Kisumu rioters, I felt sorry for our people.I just have a few questions….
1. Will naming the cabinet eradicate the flying toilets or the slums magically?A non cabinet system would even benefit the slum dwellers more by ensuring extra monies in the budget to help them.They should be crying for no-cabinet….”give us that money”.
2.What are those young boys in Kisumu doing? aren’t they suppose to be in school?Education will save you NOT the cabinet!
JUST A THOUGHT. Am surprised the RV Talibans and the KKK haven’t reacted yet.Could be that Kenya Army in their midst.

Well spoken and thought out!
I think we dont need cabinet ministers anyway. Teh ministries are running well and evenrything seems ok apart from parliament. I wish the PS’s couls approve budgets and such. To me thats why we dont need PNU or ODM permanent secretaries. In such stalemates, we would throw the country to the dogs. I think we only need a president, a vice presidnt and a prime minister who is a leader of the opposition. The rest is luxury and unnecesary costs. 3 months without them has proved it! I hear theres already a plan to relocate the railway. So they can be contained in the slums. Raila rejected the slum upgrading project in kibera. So i think the government plans to allow them to stay the way they want (or the way their MP wants) and they can remain poor errand stone throwing boys for a pittiance). I wish we would travel to coast, central, eastern, North eastern, and even many parts of kenya, Kazi kama kawaida. These crooks are fending for themselves. the average kenyan hasnt come anywhere in their agenda for the last 3-4 months after the election. They share the loot first, we can get the breadcrumbs. Ive come to know what my father told me years ago. Never wait for anyone to change your destiny. Take it upon yourself, and take responsibility. Never wait for anyone. I dont need a leader to change my world, ill be the ;eader who will change my world. To hell with raila and Kibaki, they dont care about me either. I need to be rich and that way i wont be a victim of their philosophies and plans. Lets get down to work, theyre also at work-for themselves. If theres an election, well do them justice!
Leodd;
well said on destiny. why dont the fellows uprooting the railway think the same?
KE;
9 years in & out of Kamiti may take you off center but not enough to lose it totally. Think of Mandela’s 27 years.Koigi did 13 years+, Shikuku had some too, they’re both wierd, so it must be a kenyan thing.
but you’re right when you say the odm pushed the kikuyu to the wall,
making it that much harder for kibaki & co to yield even 1 inch. the bigger mt.kenya dons see what the poor are getting (killed & uprooted), and they figure their wealth wouldn’t last 1 day under an odm govt.
@LEODD
“I don’t need a leader to change my world. I’ll be the leader to change my world”…..Thats the greatest quote by a Kenyan…Due to the prevailing Kenyan political situation it’s probably par with MLK “I have a dream “speech…..I will pass that quote forward to the next generation. God Bless your mind.

MOBITELEA- Ati MOI BIWOTT TELECOMMUNICATIONS OF EAST AFRICA.
Reminds me of another jive…BIDCO, famous for Kasuku brand and now Kimbo cooking fat. Ati BIWOTT DANIEL COMPANY. Kenyans are a creative lot. Reminds me of the days BIWOTT was connected to everything….probably even the natural oxygen Kenyans breath.
