No Taxation If you Want Representation
In this world, people who complain about paying taxes can be divided into two classes: Men and Women.
I must say, that after the former MP’s were voted outed in such large numbers, I thought these new set of MP’s would become more attuned to the overwhelming public pulse about this issue of taxes, but it doesn’t seem to be happening.
This is yet another reason why I have repeatedly said that democracy cannot work in Africa and Kibaki should not even try to rule the country democratically. According to the Standard:
“Last week, Michuki was arm-twisted by MPs to drop the proposal to tax their allowances after they threatened to shoot down the crucial Finance Bill. If the MPs had shot down the Bill, the Kenya Revenue Authority would not have the legal mandate to collect taxes from Kenyans next year”.
If Kibaki had balls, he would tell the KRA to tax their salaries and he would tell the exechequer to comply with this order. If the MP’s then threaten to go on strike, let them do it, but Kibaki should just force all the other civil servants to keep working and force the KRA to continue to collect taxes.
You either have a country that is defined (completely) by the rule of law or you drop the illusion of it’s existence and just rule the country like a complete dictator.
You know what Al Capone used to say when people asked him why he never paid taxes? Direct quote: “They can’t collect legal taxes from illegal money”.
The Kenyan MP’s should use this same argument because at this point, they are behaving like Al Capone’s runners.

I understand where you’re coming from, but phrases like that might alienate half of your audience. But if I recall correctly, it’s usually men who are indicted for white-collar crimes, including tax evasion

A decision such as you suggest should not even require dictatorship, benevolent or otherwise. The problem is that much as i have been a supporter of PNU, i have never really thought of Kibaki as a leader. The only reason i voted for him is because i considered Raila an untrustworthy, dangerous megalomaniac who would destroy Kenya. Kibaki on the other hand is a cowardly, craven, indecisive “leader” who can never make ANY decisions. Indeed, apart from taxing the MPs, he should reduce their pay and peg their allowances to actual work done and parliamentary attendance, and if they don’t like it they can take a flying leap. After all, such a move would have the overwhelming support of the people. However, Kibaki has never had faith in the people and is uncomfortable around the ordinary hoi polloi and has no idea how to relate with them, yet THEY are the Kenya he rules.
What Kenya requires is fresh young leadership under 50, preferably even before 2012. Why should we wait till then? The system as it is now does not need an overhaul, it needs brand new 21st century material.
In my view the system and its leadership is like an old 504 while what it should be is a Toyota Prius.

Kibaki campaigned on a platform of “Kazi iendelee” meaning things to continue like they where…..well to me is continue the same laid back style of leadership as long as things get done. Unfortunately this kind of leadership is not conformational and may not root out the bad weeds…
Raila campained on a platform of “change” or ” Chungwa Moja, Maisha Boraa”. I promise you that chungwa is very bitter now especially to his constituents as prices of commodity continue to shoot up. In other words, he conned whoever voted for him.

The Kenyan youth should only vote for someone who is less than 50 years old in 2012. Of course, the candidate should meet the minimum requirements of integrity.

Kibaki is the lessor of two evils– and after seeing Raila’s association with these violent Kalenjin groups, I am glad Kibaki stayed put (even if you think he rigged). To have a man like william ruto in power would have been a bloody and violent disaster for Kenya.

Anglo-Leasing contracts were all signed before 2002 during Moi’s time. Many of those who were involved in drafting and signing those contracts are now in ODM.
That is not say that more could not have been done to cancel them. But I understand the government was facing legal suits of billions of shillings because bizarre as it sounds, all Anglo-Leasing contracts were legally sound.

once again, kenya problems should have a kenyan solution. i do not see how we can go to Hague and come back home and say justice is done. the root caused of the problem needs to be addressed. the only people to do that are the kenya leaders. the constitution needs to be drafted a new. people needs to be allowed to vote on it. corruption needs to be eradicated. people needs to be involve in government processes. poverty needs to be eliminated. land issues needs to be address. it is sickening to walkup each morning and see this so call leaders fighting. i used to think that kalonzo was the guy to lead kenya, but after the last election i realised the guy is an hypocrite. it seems like people go to parliament with good intentions. once they get there something overtakes the purpose and reasoning. Ruto may not have done the killing personally but he sure incited (just like Hitler never personally killed anyone during the second world war). All his speeches have been recorded and they will be used against him. So your point does not hold water.
Yes it is true that the Hague will not solve the root causes of the problem, but that is not the objective of the Hague. The Hague is a criminal court dealing with criminal offences i.e. crimes against humanity, genocide, murder, torture, ethnic cleansing etc.
The root causes of the problem will only be dealt with politically in Kenya.
The point of the whole exercise is to ensure that political disputes are not resolved through mindless primitive moronic violence but through civilised negotiations and dialogue.
Impunity must and will end in Kenya.

Any evidence (recorded or not) against Ruto and other inciters will never be used against them in Kenya. This is what is called IMPUNITY.
However, this same evidence under the microscope of the Hague will suddenly be as valuable as platinum or pink diamonds.
As for Ruto’s speeches, go on Youtube and you will find them. I do not claim to have them. They are in the public domain. There are others caught in that net too such as Anyang Nyong, Gumo, Ntimama etc.

Why are you guys discussing the hague? I keep telling you that not even people died in Kenya to warrant a case at the Hague or at the international criminal court.
Those courts are reserved for the world’s worst atrocities and Kenya’s election violence was nothing near a catastrophe (especially for Africa, which has seen such horrible violence).
A more important issue is to focus on why Kibaki is trying to negotiate a deal with Ruto. That is not just unbelievable, it is dangerous. Ruto is young and if he lives, he could be involved in politics for many years to come, which would give him many opportunities to use violence again.
Even Raila now realizes how dangerous Ruto is. They cannot allow him to get anywhere near the halls of power.
Raila has to get away from those Kalenjins and this is not a tribal statement on my part. You simply cannot associate with people like that if you want to create a civilized society.

I said the reason why Ruto or any other inciter will not be prosecuted in Kenya is because of impunity. It is NOT cowardice. It is the fact that the judiciary and other state organs inclduing parliament do not function properly. That is the problem.

This is a criminal matter and “intent” in law has a different interpretation from “intent” in normal language use. Do a bit of legal digging and you will understand what I mean.
These guys will eventually face the ICC if they try a cover-up in the local Tribunal.

I think you are getting hung-up on irrelevant legal minutae and you are forgetting to analyze this issue within a broder context, but before I talk about that, let me first explain to the other readers what it is you are talking about.
In order to successfully prosecute someone for a criminal act, you must first establish or prove certain elements of the case. The first element in all criminal cases that one must prove is called the “mens rea” or the mental intent of the criminal. This is what Kei O is talking about.
However, intent, is not the only element that must be proved in a criminal case. After establishing intent (i.e. showing that the person wanted to commit this crime), you then must establish the “actus rea” or the “act — i.e. you must show that the person not only intended to kill, but did in fact kill or got someone else to kill on their behalf.
In advanced countries, establishing the mental intent of a person is important because you cannot criminally prosecute somone who is not of sound mind and that is why this rule of intent exists. You are essentially trying to show that the accused was not insane at the time the crime was committed.
However, this is all irrelevant to the larger issue at hand, which is that william ruto will never even get to the hague or the ICC because these institutions are at their base, POLITICAL institutions. Unless the government of kenya, acts uniformly and tells the ICC or the Hague that they want to prosecute ALL the perpetrators of the violence, no case will ever be brought against them.
This is why I have said that the best way to deal with violent perpetrators is to copy the Israeli method of targetted assasinations. It is what America did after they were attacked on 9/11 (they’ve been finding these guys and killing them) and by the way, America has refused to join the ICC and I doubt obama will join it either. Counntries want the freedom to be able to go after their enemies and eliminate them.
I also expect India, after the attacks in Mumbai, to do the same thing against the terrorist camps in Pakistan. They are going to launch raids into pakistan and kill those people.
Another good example is Kagame. There’s a reason the planners of the genocide are in hiding. Kagame is looking for them and he has no intention of bringing them to the hague (and they know it).
These international institutions are highly overrated.
I think that the very fact that there will be a tribunal is a milestone in Kenyan history.
It will certainly act as a deterrent against future excesses if anything.

The rule for establishing culpability in criminal cases is the same one used in the Kenyan legal system. It is the common law system which Kenya adopted from the UK. It is wrong for you to say that it is only used in the so called advanced countries.
However, we all know that the Kenyan judiciary has been an embarrasment over many years. Things are not done as they should be done. This is why there was that idea of the Radical Surgery of the Judiciary in 2002 which I understand did not amount to anything.
A local tribunal does not inspire much confidence in achieving justice for the innocent victims. Some people support a local tribunal in the hope that they will manipulate its outcome. This is common knowledge.
But as Josh says, the very fact that the government has been forced to constitute a tribunal should tell you how serious this issue has become.
For your information, if the local tribunal is not constituted within the stipulated time, the ICC will AUTOMATICALLY step in and issue arrest warrants for those in the now famous envelope. This means that Kenya (and other ICC signatories) will be required to immediately arrest them and hand them over to the ICC.
I understand there are 6 ministers and 5 Mps in the envelope (I could be wrong).
Can’t you see how serious this would be????
Now, it doesn’t matter whether they are found innocent at the ICC or not – the damage will already have been done to their careers.
And another thing you must remember is that the Waki report will not be the sole evidence used for prosecution. Witnesses will appear before the commission and other evidence will also be adduced against the suspects (and I insist suspects). This is where the problem lies – in that there is a real possibility that the suspects could be actually be found guilty.
NB: No one knows who is in the envelope (Ruto may not even be in the envelope). So let us stop assuming that we know who is in the envelope until it is opened.
If the threat of future violence in Kenya is not dealt with once and for all, this is what am gonna do:
- liquidate all my assets and investments in Kenya
- ship out all my close family members
Never step in Kenya again except as a tourist.

Josh…folding up and running away from responsibility is not the solution. Here’s a clear process towards sensible governance in this country:
1. We (Kenyans) admit that we have failed our generation, and those to come by voting along tribal; wealthy family name lines, etc.
2. Embark on an intensive civic education process to educate (especially) the large rural population on the sense to elect leaders based on issues that will see future generations inherit a better country that we found.
3. Change the constitution through the people….not a few greedy (MPs) individuals who are only out to amend sections of the constitution that guarantees them fat checks.
