On General Tuwei -- commander of what? He is not the head of the army and I highly doubt he will get that position. Look who is directly &quot;underneath&quot; him -- a guy called Mwaniki.  

I told you guys a year ago that they were going to re-align the security services and that is exactly what is happening right now.  However, I also said this process would take 2 or more years.  Don&#039;t get excited about tuwei -- Kibaki still has 3 more years to re-align things.</description>

1. We (Kenyans) admit that we have failed our generation, and those to come by voting along tribal; wealthy family name lines, etc.
2. Embark on an intensive civic education process to educate (especially) the large  rural population on the sense to elect leaders based on issues that will see future generations inherit a better country that we found.
3. Change the constitution through the people....not a few greedy (MPs) individuals who are only out to amend sections of the constitution that guarantees them fat checks.</description>

The rule for establishing culpability in criminal cases is the same one used in the Kenyan legal system.  It is the common law system which Kenya adopted from the UK.  It is wrong for you to say that it is only used in the so called advanced countries.

However, we all know that the Kenyan judiciary has been an embarrasment over many years.  Things are not done as they should be done.  This is why there was that idea of the Radical Surgery of the Judiciary in 2002 which I understand did not amount to anything.

A local tribunal does not inspire much confidence in achieving justice for the innocent victims.  Some people support a local tribunal in the hope that they will manipulate its outcome.  This is common knowledge.

But as Josh says, the very fact that the government has been forced to constitute a tribunal should tell you how serious this issue has become.

For your information, if the local tribunal is not constituted within the stipulated time, the ICC will AUTOMATICALLY step in and issue arrest warrants for those in the now famous envelope.  This means that Kenya (and other ICC signatories) will be required to immediately arrest them and hand them over to the ICC.

I understand there are 6 ministers and 5 Mps in the envelope (I could be wrong).  
Can&#039;t you see how serious this would be????

Now, it doesn&#039;t matter whether they are found innocent at the ICC or not - the damage will already have been done to their careers.

And another thing you must remember is that the Waki report will not be the sole evidence used for prosecution.  Witnesses will appear before the commission and other evidence will also be adduced against the suspects (and I insist suspects).  This is where the problem lies - in that there is a real possibility that the suspects could be actually be found guilty.

NB:  No one knows who is in the envelope (Ruto may not even be in the envelope).  So let us stop assuming that we know who is in the envelope until it is opened.</description>
